Terms of Service

1. Acceptance of Terms

By accessing or using Resonance CX ("Service"), operated by Bluvations, LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Resonance CX is a customer experience analytics platform that maps interactive voice response (IVR) phone trees by placing automated calls, recording the audio, and producing visual maps and recommendations. The Service may include free and paid subscription tiers.

3. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use this Service. By registering, you represent that you meet these requirements.

4. Account Registration

You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential. You are responsible for all activity under your account.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Initiate calls to numbers you are not authorized to test
• Attempt to interfere with, compromise, or disrupt the Service infrastructure
• Reverse-engineer, decompile, or disassemble any part of the Service
• Resell, sublicense, or redistribute Service outputs without written permission
• Exceed usage limits associated with your subscription tier

6. Call Recordings & Data

The Service places automated calls to telephone numbers you provide and records the resulting audio. You represent and warrant that you have the legal right to initiate calls to such numbers and to record them (including compliance with all applicable consent and wiretapping laws). We are not responsible for your compliance with local recording consent requirements.

7. Intellectual Property

All rights, title, and interest in the Service, including its software, design, branding, and documentation, remain the exclusive property of Bluvations, LLC. You retain ownership of data you provide to the Service. We retain ownership of all derived analytics, models, and map structures generated by the platform.

8. Subscriptions & Payment

Paid features require a subscription processed through our payment provider (Stripe). Subscription fees are billed in advance on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are not provided for partial billing periods unless required by law.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUVATIONS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Sections 7, 9, 10, and 12 survive termination.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in California.

13. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or a prominent notice within the Service. Continued use after changes constitutes acceptance of the updated Terms.
